Many investigations are aimed at a revocation of the physician's license.
Top priority is the preservation of the physician's license. Therefore,
at the first contact from the licensing board, even if it appears to be
nothing more than a benign request for medical records, the physician should
immediately seek competent, knowledgeable counsel to guide him/her, before
doing anything. A physician, or any other licensee, should never deal with
investigators or other representatives of the licensing board without advice
of counsel, presence of counsel at any meetings with the representatives
of the licensing board.
Practice Tip: Always attempt to ascertain the nature of the
complaint being investigated, in as much detail as possible before going
to any interview with a board investigator. Consult with your attorney
to determine whether your attendance is mandatory or discretional. There
may be times when the best procedure is not to appear at an investigational
meeting.
Remember, currently medical boards throughout the country are placing physician
"information" on the Internet. There are many problems that this can cause
the physician, because, in my opinion, it is not possible to put all the
relevant information on the Internet page - commonly leaving out
exculpatory material..
